Terms and Conditions
- Information on how to participate in Downland Dance’s live studio, live online, and on demand (including catch up) dance classes including all schedules, information, payment and refund policies and frequently asked questions form part of these terms and conditions.
- Participation in any of Downland Dance’s live studio, live online, and on demand (including catch up) dance classes will be considered acceptance of these terms and conditions, and any ongoing updates to these terms and conditions.
- Downland Dance is the owner of the live studio, live online, and on demand (including catch up) dance classes.
- To participate in live studio and live online classes, participants agree to have their attendance registered and provide Downland Dance with true and correct information including full name, phone number, home address, email address, date of birth (for under 18s) and next of kin contact details in case of emergency.
- To view on demand classes, catch up classes, and other content available via the Downland Dance online Members’ Area, participants agree to provide Downland Dance with true and correct information including full name, email address, and valid payment details.
- Classes may have restrictions and/or guidelines in place relating to a participant’s age and/or ability. This may include the requirement that a parent/carer aged 18 years or older must accompany a minor to register, pay, participate in and complete Downland Dance classes and associated requirements for participation.
- The definition of participant is the singular person registering, paying and participating in a class and associated activities, including use of the content available in the Downland Dance online Members’ Area (web address: www.downland-dance.co.uk/members), in accordance with these Terms and Conditions. This definition extends to the parent/carer of a minor, whereby they are both considered the participant, as one and the same, for the duration of the participation in Downland Dance classes.
- By registering to participate in Downland Dance classes, or to have access to our Downland Dance Members’ Area, you opt in to receive communication from Downland Dance and third party providers engaged by Downland Dance such as registration, delivery and feedback platform service providers to enable full participation in the Downland Dance classes.
- Promotions are available for a limited time only, for as long as it is advertised by Downland Dance. Downland Dance has the right to cancel or change any promotion at any time without notice and at its sole discretion.
- Downland Dance will provide information to dance class participants about any third party service provider requirements and participants may need to register with these providers, as well as accepting terms of service, not managed or controlled by Downland Dance.
- Participation in Downland Dance classes may be regulated by minimum or maximum participant numbers. Where participation numbers need to be controlled, attendance will first be controlled on a rota system organised by Downland Dance, and then on a first-come, first-served basis where further control may be necessary. Where participation numbers do not meet Downland Dance class guidelines, participation is not guaranteed.
- Classes may be physically strenuous, and participation is voluntary, based on a participant’s own assessment of their fitness, health, ability to participate and understanding of the class requirements, activities and expected outcomes. Participation is based on an understanding and knowledge there is a risk of personal injury or death.
- By entering the premises, including online class locations, participants agree that Downland Dance is in no way responsible for personal injury or death. Participants are responsible for ensuring one’s own physical and mental health for, during and after classes including injury rehabilitation and general post-class care.
- Participants who are late to class may be refused entry.
- From time to time Downland Dance may provide guidelines to assist participants with their personal dance practices and participation in Downland Dance classes. This may include checklists, standards, research, written guides or other similar material and is provided as supplementary content to support registration, payment, participation and associated activities related to Downland Dance classes. Acceptance of these materials is at personal risk, based on the participant’s personal analysis of the information, the environment, their capabilities, personal medical advice, the teaching content and style and any other associated information.
- By entering the premises, including online class locations, participants agree that Downland Dance is in no way responsible for property damage or loss including items which may be stolen. Participants are responsible for their own belongings and property.
- Participants agree they will not sue or make any other claims of any kind whatsoever against Downland Dance or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
- Fees for participation in Downland Dance classes, and use of the Downland Dance online Members’ Area, are payable as part of a subscription package. Subscriptions are available to:
- Local Members – i.e. participants who attend live classes in the studio and/or online, and also have access to on demand (including catch up) classes via the Downland Dance Members’ Area (local members are usually local residents to the areas where Downland Dance studios are situated).
- Virtual Members – i.e. participants who have access to on demand (including catch up) classes via the Downland Dance Members’ Area only, and do not have access to live classes in the studio or live online classes.
- Subscriptions form part of the registration process and must be enabled prior to participation in a class. Subscription fees will renew automatically at the end of their payment term, unless the subscription has been paused or cancelled. Once paid, fees are final, non-refundable, non-transferable and non-extendable beyond their expiry.
- Subscription payments for Local Members are collected monthly from September – July each year inclusively. Local Members subscriptions are automatically paused for the month of August each year, and any classes attended in that month will be charged on a Pay As You Go (PAYG) basis.
- Subscription payments for Virtual Members are collected monthly until their subscription is cancelled.

- The subscription term for Local Members is considered to run from the first to the last day of each month, regardless of which date within the month payment is taken.
- Subscriptions can be paused, edited or cancelled in the following ways:
- Local Members can pause, edit or cancel their subscription at any time by contacting Downland Dance in writing. The subscription will be paused, edited or cancelled after payment has been collected for the month in which notice was given. This can be on any date, at Downland Dance’s discretion, up until the last day of the month in which notice was given. Any payments due within the interim period are considered payable and will be collected. Members with paused subscriptions will have no access to the Downland Dance Members’ Area until their subscription is re-activated. Members may re-activate their subscriptions by contacting Downland Dance in writing.
- Local Members who give notice to cancel a subscription may continue to attend classes until the last day in the month in which they gave notice.
- Virtual Members can cancel their subscription at any time by cancelling payments through the PayPal account they used to sign up, or by contacting Downland Dance in writing. Once cancelled, no more payments will be taken, and access to the online Members’ Area will be revoked up to 1 month after the last payment was made. Instructions for cancelling Virtual Membership can be found inside the Downland Dance online Members’ Area by clicking: ‘My profile’ > ‘Delete Account’.
- Local Members may be invited to attend a free trial class prior to enabling a subscription.
- Virtual Members may be invited to start a free trial period of the Downland Dance Member’s Area, for a time limit determined by Downland Dance, conditional to submitting their personal details (including payment details) prior to staring the free trial. Virtual Members may cancel their subscription at any point during their free trial period to avoid being charged the first month’s membership, but understand that their paid subscription will automatically begin at the end of their free trial period if their subscription has not been cancelled prior.
- Some participants may be able to opt to pay for classes on a Pay As You Go (PAYG) basis, at the sole discretion of Downland Dance. Such an arrangement must be agreed in writing between the participant and Downland Dance prior to the participant attending classes. PAYG members are not granted access to the Downland Dance Online Members’ Area.
- Up to date fees for PAYG participants can be found at https://downland-dance.co.uk/prices.
- Participants grant Downland Dance the right to use personal information and images including still and video footage for marketing and communication purposes deemed reasonable by Downland Dance. Project image release forms may be issued to participants if Downland Dance wishes to expand the use of personal information and images beyond reasonable marketing and communication purposes.
- Downland Dance will not be responsible for any problems or technical malfunction of any network or lines, servers, providers, computer equipment, software, traffic congestion on the Internet, etc. including, but not limited to, any injury or damage to participants or any other person’s computer related to or resulting from registering for, participating in or downloading any materials to enable full participation.
- Participants are not permitted to record, download or share class content with non-participants and this includes the sharing, recording or downloading of Downland Dance class content between devices, platforms or networks, which is strictly prohibited, unless express written permission to do so is provided by Downland Dance.
- Participation in all Downland Dance classes is dependent on each participant demonstrating respectful, courteous, honest and appropriate behaviour. Inappropriate behaviour is classified as anything verbal or non verbal that may be actual or perceived intimidation, harassment, discrimination or abuse.
- Participants in breach of these Terms and Conditions may be removed from Downland Dance classes, in whatever format they are delivered and ongoing participation may be refused. This will be at the full discretion of Downland Dance.
- The full schedule of classes, or any part thereof, may be cancelled, suspended, modified or withdrawn at any time without notice. The participant agrees to indemnify Downland Dance against any loss or damages caused by a cancellation, suspension, modification or withdrawal of classes or where a sponsor, partner or supporting individual or organisation fails to fulfil their duties.
- Downland Dance reserves the right, at any time, to verify the validity of a participant’s registration and to reject or disqualify a participant from participating in any classes.
- By participating in classes, participants acknowledge that they have read and agree to Downland Dance’s policies, including the Photograph and Video Policy, and the Appropriate Physical Contact in Dance Policy.
- By participating in classes, or using by using the Downland Dance online Members’ Area, participants acknowledge that they have read and agree to Downland Dance’s privacy policy.
- Downland Dance reserves the right to amend these terms and conditions at any time.
